Stalking Investigations in Florida

A Florida stalking investigation organizes a pattern of unwanted conduct, preserves its sources, and develops facts for safety planning, counsel, law enforcement, or an authorized workplace response. It is not emergency protection and should never delay a 911 call when danger is immediate.

Understand the Pattern Florida Law Describes

Florida Statutes section 784.048 defines terms including harassment, course of conduct, credible threat, and cyberstalking. Whether reported conduct satisfies those definitions is a legal and law-enforcement question; the investigator's role is to preserve events and sources without labeling a person guilty.

Begin with dates, locations, exact communications, account identifiers, witnesses, vehicles, prior relationships, police incident numbers, injunctions, and safety concerns. A sequence is often more informative than a folder of unsorted screenshots.

Preserve Digital and Physical Events

Keep original messages, emails, voicemail files, envelopes, gifts, camera clips, access logs, and platform data. Record when and how each item was received. Export data where a platform permits and avoid repeated forwarding that strips metadata. Note blocked accounts, new identifiers, impersonation, attempted account access, and contact through third parties.

Physical-event documentation may include witness interviews, lawful scene review, vehicle or subject identification, and limited field observation designed around a specific safety question. It should not provoke contact, impersonate the subject, or create additional risk for the client.

Coordinate Investigation With Safety Planning

Decide in advance what triggers an emergency call, non-emergency report, workplace notice, school protocol, attorney contact, or location change. Do not confront the suspected stalker to obtain a reaction. Limit public disclosure of routines and preserve evidence before changing accounts or devices when it is safe to do so.

Florida also provides a civil cause of action for a stalking injunction under section 784.0485. A lawyer or clerk can explain filing requirements; a PI cannot promise that collected material will establish the statutory elements or that an injunction will issue.

Build a Source-Traceable Incident Chronology

The report should identify each event, source, timestamp, witness, preservation step, and relationship to earlier conduct. It distinguishes direct contact, third-party reports, technical indicators, public-record facts, and unverified attribution. Contradictory evidence and gaps remain in the chronology rather than being edited out.

Attribution of anonymous accounts, phone numbers, or devices may require platform process, counsel, law enforcement, or a digital-forensics specialist. Open-source similarities can generate leads but rarely prove identity alone.

Scope the Case Without Increasing Exposure

Ask who receives updates, how contact will avoid unsafe devices, which addresses must be protected, what information may be shared with counsel or law enforcement, and what methods are prohibited. Verify the agency and assigned investigator in the FDACS license database.
